General terms and conditions for the rental of the Casa Momo apartments, Moritz Steinlechner, Schönaugasse 76, 8010 Graz, Austria.
1. Scope
These terms apply to the short-term rental of the Casa Momo apartments to guests for private or business stays.
For bookings made through platforms (e.g. Airbnb or Booking.com), the terms of the respective platform also apply. Where they conflict with these terms, the platform’s terms take precedence.
2. Booking & contract
A booking creates a binding accommodation contract. For direct bookings on our website, the contract is concluded once the payment has been completed successfully; you will receive a confirmation by email.
The booking applies to the stated number of guests and the booked period.
3. No right of withdrawal
Under § 18 (1) no. 10 of the Austrian Distance and Off-Premises Contracts Act (FAGG), there is no statutory right of withdrawal for accommodation services booked for specific dates. The cancellation policy under section 6 applies.
4. Check-in & check-out
– Check-in from 4:00 pm
– Check-out by 11:00 am
– Earlier check-in or later check-out is possible subject to availability and for an additional fee.
5. Prices & payment
All prices are final prices in euros per stay and include the final cleaning.
The City of Graz tourist tax (currently €2.50 per person aged 15 and over per night) is not included in the accommodation price and is shown separately.
For direct bookings on our website, the total amount including the tourist tax is paid at the time of booking via the payment provider Stripe. For bookings through platforms, the platform’s payment terms apply.
6. Cancellation policy
Free cancellation up to 5 days before arrival: you can cancel free of charge up to 5 days before your arrival date and receive a full refund. Example: for arrival on 10 December, cancellation is free up to and including 5 December.
Cancellation from 4 days before arrival and no-shows: the full price of the stay is charged. The tourist tax is refunded, as it only applies to nights actually stayed.
Early departure: if you leave early, the price of the stay is not refunded. The tourist tax for unused nights is refunded.
How to cancel: send an email to office@casamomo.at. The time your message reaches us is what counts. Refunds go back to the payment method you used and usually take 5–10 business days.
Changing your dates: if your plans change, feel free to ask us about different dates. We will do our best to find a solution, as long as the apartment is available.
For bookings made through platforms (e.g. Airbnb or Booking.com), the cancellation policy of the respective platform applies.
7. Use of the apartment
– The apartment may only be used by the number of guests booked.
– Parties, events and loud celebrations are not permitted.
– Smoking is not allowed in the apartment.
– Pets are only allowed by prior arrangement.
8. Liability
The guest is liable for damage culpably caused during the stay by them or by those travelling with them.
The host is only liable for the guest’s personal belongings in cases of intent or gross negligence. Liability for personal injury remains unaffected.
9. Cleaning & equipment
The apartment is handed over clean and fully equipped. The regular final cleaning is included; exceptional soiling may be charged separately.
10. Additional services
– Baby cot: €20 per stay (incl. mattress, sheet, blanket and pillow; please request in advance)
– Further services by arrangement.
11. House rules
The house rules are available in the apartment or are sent before arrival. They form part of these terms and must be observed throughout the stay.
12. Privacy
How we process your data is explained in our Privacy Policy.
13. Applicable law & jurisdiction
Austrian law applies. The place of jurisdiction is Graz. If the guest is a consumer, mandatory consumer protection provisions and the statutory places of jurisdiction remain unaffected.
